These terms apply to the No Wake Zones app ("the App"), published by Gansoft SARL, Quai du Seujet 30, 1201 Geneva, Switzerland ("Gansoft", "we"). By using the App you accept them. If you do not accept them, do not use the App.

The App is not a navigation aid. Posted signs and official regulations prevail. It does not replace nautical charts, regulatory markers, the official texts or instructions from law enforcement and the U.S. Coast Guard. The operator remains solely responsible for the vessel's speed and for knowing the rules in force.

What the App is

The App shows Florida's state manatee protection zones and boating safety zones published by the Florida Fish and Wildlife Conservation Commission (FWC), and the other federal, county and local areas listed in the App, on a map with the rule in force at your position. In navigation mode it can warn you before you enter a zone. It is an information tool.

Limits

Coverage. The App covers Florida state (FWC) zones and only the federal, county and local zones listed in it. Zones adopted by cities or counties, temporary closures and other restrictions may be missing or out of date.
Data can be wrong. Zone boundaries, speed limits, seasons and hours come from official geographic data and regulations that the App processes automatically. They may contain errors, be incomplete or lag behind changes. Where the App and the posted signs or the official rules differ, the signs and rules prevail.
Alerts may fail. Alerts depend on GPS accuracy, battery level and power-saving settings, your phone's operating system (which may stop the App in the background), notification and sound settings, and signal. They may be late, wrong or missing. The skipper remains responsible at all times, whether or not an alert sounds.
Positions are approximate. A GPS position can be off by several boat lengths or more, near a boundary the App may place you on the wrong side of it.

Assumption of risk

Boating involves risks of property damage, serious injury and death, and of fines for violating speed zones. You use the App at your own risk and remain solely responsible for your vessel, your crew, your passengers, your speed and your decisions.

No warranty

To the fullest extent permitted by law, the App and all data are provided "as is" and "as available", without warranty of any kind, express or implied, including accuracy, completeness, timeliness, merchantability or fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, Gansoft shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, fines or penalties, or for any loss, injury or death, arising from the use of, or reliance on, the App or its data. Where liability cannot be excluded but can be limited, it is limited to the amount you paid for the App in the twelve months before the claim. Nothing in these terms excludes or limits rights you have under mandatory consumer protection law.

Government data

The App uses public data from the FWC and other government sources named in the App. The App is independent: it is not affiliated with, endorsed, reviewed or approved by the FWC, the U.S. Fish and Wildlife Service, NOAA, the U.S. Coast Guard or any government body. Data are used as published; any error in processing is ours.

Purchases

The map, the rules and the zone details are free. Navigation mode with alerts requires Pro, offered as:

Monthly subscription, US$14.99 per month (or the local equivalent shown in the store), with no free trial. The subscription renews automatically every month unless cancelled at least 24 hours before the end of the current period.
Yearly subscription, US$38.99 per year (or the local equivalent shown in the store). It may start with a 3-day free trial, offered by Apple or Google to eligible new subscribers: unless you cancel at least 24 hours before the trial ends, the subscription starts and is charged at its end. The subscription renews automatically every year unless cancelled at least 24 hours before the end of the current period.
Lifetime purchase, US$78.99 (or the local equivalent), a one-time payment with no renewal.

You can manage or cancel a subscription in your App Store or Google Play account settings; deleting the App does not cancel it. Purchases are sold and billed by Apple or Google. Refunds are handled by Apple or Google under their policies. You can restore your purchases on a new phone with the same store account (Settings › Restore purchases).

On iOS, Apple's standard Licensed Application End User License Agreement also applies.

Reporting errors

If you find a missing or wrong zone, please report it from the App or by email. We will review it, but we do not guarantee a correction or a delay.

Privacy

Your location stays on your phone. See the Privacy Policy.

Changes and law

We may update these terms; the App asks you to accept a new version when the substance changes. These terms are governed by Swiss law, without prejudice to the mandatory consumer protection law of the place where you live.
