These terms apply to the Florida Inlet Watch app ("the App"), published by Gansoft SARL, Switzerland ("Gansoft", "we"). By using the App you accept them. If you do not accept them, do not use the App.

The App is not a navigation aid. It does not replace official forecasts and warnings, U.S. Coast Guard instructions, nautical charts, your own observation of the inlet, or local knowledge. You alone decide whether to cross an inlet.

What the App is

The App shows, for inlets on Florida's Atlantic coast, an automated conditions index combining official NOAA tide and tidal current predictions, the NOAA GFS and GFS-Wave forecasts, National Weather Service marine advisories and coastal waters forecasts, and NOAA buoy and airport observations. It is an information and planning tool.

Limits of the index

An estimate, not an observation. The index is computed automatically from forecasts and predictions. It can be wrong, late, incomplete or unavailable, and it cannot see breaking waves, traffic, debris, fog or squalls at the inlet.
“Lower risk” is not “safe”. The lowest level only means that the data show no strong ebb-against-sea signal. Inlets can be dangerous at any level.
Sandbars move. Bar depths used by the App are rough orders of magnitude for the wave calculation only, never navigation depths. Some inlets change from one day to the next.
Estimated currents. Several inlets have no official NOAA current prediction. For them the App assumes the ebb may run over a deliberately wide window, at an assumed speed. Actual ebb times and speeds can differ.
Forecast models. Wind and waves come from global NOAA models (about 25 km and 18 km grids). Local wind, thunderstorms, squalls and wave-current effects inside the inlet are not resolved.
Official advisories prevail. The App displays National Weather Service advisories as issued but may not show them in time, for instance without a network connection. Always check weather.gov or NOAA Weather Radio, and follow Coast Guard broadcasts.
Data availability. The App depends on government services it does not control. When data cannot be refreshed, the App shows “No data” rather than an old level, but you remain responsible for checking conditions.
Built-in predictions expire. Tide and current predictions are included up to December 31, 2028; after that date the App needs an update.

Assumption of risk

Boating, fishing, diving and paddling in and near inlets involve risks of property damage, serious injury and death. You use the App at your own risk and remain solely responsible for your vessel, your crew, your passengers and your decisions, including the decision to cross an inlet or to turn back.

No warranty

To the fullest extent permitted by law, the App, the index and all data are provided "as is" and "as available", without warranty of any kind, express or implied, including accuracy, completeness, timeliness, merchantability or fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, Gansoft shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or for any loss, injury or death, arising from the use of, or reliance on, the App or its data. Where liability cannot be excluded but can be limited, it is limited to the amount you paid for the App in the twelve months before the claim. Nothing in these terms excludes or limits rights you have under mandatory consumer protection law.

Government data

The App uses public data from NOAA, the National Weather Service, the National Data Buoy Center and the Aviation Weather Center. The App is independent: it is not affiliated with, endorsed, reviewed or approved by any of these agencies, the U.S. Coast Guard or any government body. Data are used as published; any error in processing is ours.

Subscription

Current conditions and official advisories are free. The yearly "Inlet Watch Forecast" subscription unlocks the forecast. It is sold and billed by Apple or Google, renews automatically every year unless cancelled at least 24 hours before the end of the current period, and can be managed or cancelled in your store account. Refunds are handled by Apple or Google under their policies. On iOS, Apple's standard Licensed Application End User License Agreement also applies.

Privacy

The App has no account and sends no personal data to us. See the Privacy Policy.

Changes and law

We may update these terms; the App asks you to accept a new version when the substance changes. These terms are governed by Swiss law, without prejudice to the mandatory consumer protection law of the place where you live.
